Tier2 ICT -Established Staff to Tier2 G - ILR

Need clarification for the below

I am under Tier2 ICT - Established Staff visa which was stamped in May 2010. The visa has been extended in UK since then and the latest tier2 ict - established staff visa is until Nov 2016.

Q. Now if i switch to Tier2G visa from within UK, then will i be eligible for ILR in May 2020 (under 10 yrs rule)?
Q. or 2021 under (5 year tier2g rule)
Q. Is there a 6 year cap for the Tier2G visa period? if yes, whats the start period? start of tier2g or tier2 ict?

2. Yes; both are possible.
3. The 6 year period will start from the day you move to T2 General visa.

Hi,

I am about to move from Tier 2 ICT (under rules before 6-Apr-2011) to Tier 2 General.

1st Visa issue date - Aug-2010
Entry into UK - May 2011
Since then I have been in the UK with 2 more ICT extensions.

Now I want to switch to a new employer (Tier2 General In-country switch)


I have few queries as below.

1. Since I have entered the UK after 6-Apr-2011, will there be an issue for my in-country Tier 2 General application.
I am asking this as I heard from my friend that I need to enter UK before 6-Apr-2011 to make an in-country Tier 2 General application.
Is it true that it's the entry date which matters and not the visa issue date?

2. Can a Tier 2 General visa be issued for a future date or will it be valid straight away making the previous visa invalid?
If it is issued for future date, will my current visa be valid till that date as I am in the UK?

I am worried about these questions as I have to take care of the notice period with my current employer into consideration.

If so what are my options as I have an employer who wants to process my Tier 2 General Incountry application. Please advice.

Your date of stamp on your visa matters and not Entry date i believe.
If you are not a Tier 2 ICT Established staff, you will need to serve a 12 month cool off period unless your prospective employer pays you > £155,300 pa

@Gopal:
1. The visa issuance date is considered, hence you can switch to Tier 2 General from within UK.

2. The visa shall be issued as per the dates mentioned in the CoS (which will be assigned by your new organisation). They cannot assign CoS for later than 3 months since it has to be used within this period. You can work for your existing employer until the start date mentioned on the new visa. You cannot work beyond that

Once my Tier 2 ICT visa is switched to Tier 2 General in-country,
Is it possible to go on leave immediately outside country for one month?.
Please advice.

I think as long as you get back your new BRP and Passport you should be fine
