Tier 2 General visa issue

Post by shaiderrn » Fri Jul 08, 2016 11:09 pm

I was sponsored in 2013 march and visa extension was on April 2016, but my company license was suspended in March 2016, and they have appealed for it and also take JR to submit my application, court allowed me to submit the application. But after few days the Company license was revoked and our company is now fighting the case in court. i had to live 2 more years on tier 2 to get indefinite.
i have no idea what outcome will be of my application, i am mentally prepared to get a refusal of application i am looking for options what options do i have other than finding new sponsor and Entrepreneur ....
Our company is international company having offices in 3 countries and 12 employers are on sponsored visa, and all of them are in senior level jobs including myself. Company is doing all they can to get the license back, i want to know what are the chances of license to be reinstated ? and how long it takes from revoking to reinstating ?

Thanks

The chances of getting the licence reinstated from revocation are very low indeed.
If your company has made representations and they failed to stop the revocation there is little prospect of the revocation being overturned at JR. UKVI take a great deal of consideration before a licence is revoked. If there are not firm grounds for the revocation to stand the test of a JR they are not likely to go down that route.

The JR process is long and complicated. If they are given the right to a hearing in the first place the to and fro after that can take months. The vast majority of Tier 2 cases don't get past the initial stages so don't get grant of hearing and the appeal is thrown out.

If your company seeks interim relief then that is the only way your application will be considered. At best that would move the licence to suspended and as you state you were allowed to submit while suspended then your application could be considered. I stress the word could.

Personally I don't see your application being consider at all until such times as the company JR is decided. They will just sit on it waiting for the final outcome of the JR.
