FLR FP application issues

Hi there, I'm new to the board. I have been in the uk for 4 years on an FLR visa as the father of my son. My son was born in Australia but his British mum and I moved here to raise him.

I have just applied for my extension and have received a letter in reply stating that my case raises issues relating to the European convention on Human Rights and that it will now be passed on to assess but falls outside their standards for processing.

I work, pay tax, own a home, have a step child and a wife here. Why is there any issues with this?

I'm part of the commonwealth, hold a valid Australian passport and contribute daily.

Has anyone heard of this reply before?

For clarity, why were you unable to apply for FLR(M)? Are you in another relationship and no longer living with your son's mother?

Yes my sons mother and I split shortly before my marriage visa was ending which is why I switched to the fp status.

In which case, the letter is likely to be a standard notification.
FLR(FP) applications/extensions always come under greater scrutiny and I suspect that the Case Worker will want to verify that you are still involved in the care & support of your son, under the terms of which your FLR(FP) leave was originally granted.

Thank you for the information Casa. I am hoping that is the case although I provided letters from friends, nursery, photos from holidays as well. I'm not sure what else they would need?

Maybe nothing more, but as I mentioned in my previous post FLR(FP) applications are rarely processed to the same timescale as the 'standard' visa categories and the HO are required to notify you when they are unable to meet the published guidelines for processing.
Rest assured that you remain legally resident while you are waiting a decision.

My husband has the same issue but we have applied FLR FP as FLR M was the first application we applied for to change his stuednt visa to spouce. He was under the 10 year route and how for his extension we recieved the same acknowlegdment letter as you.

Please let us know what your outcome was.
