My husband currently lives in the US ...

He doesnt have any documentation in the US. I come and go to the US to visit him .. We have 2 kids both born in the US.

I work in the Uk and earn £21,500 a year.
My husband has a pakistani passport ..

My question is that when i return back to the UK i would like to sponsor him..

Will he have to return to his home country (pakistan) or can i sponsor him from the UK whilst he is still in the US

You should be present legally in the country or territory you’re applying from.

He will have to return to Pakistan and submit a spouse settlement visa application from there.

Do your children have British citizenship? If not and they are still living in the US you will also have to apply for entry visas for each of them. You say you are working in the UK. Do you have settled status (ILR or PR), or hold British citizenship? If not, what category of visa do you have?
