Our situation: We've only just got married for a few days and we are not living together yet because of work. But we will move into a new place in August. My husband is British and I am holding a Tier 2 general visa. But I will quit on 31th August and my employer will inform the Home Office on that day that I'm not sponsored by them anymore.
Question 1: Is the length of marriage a factor that the Home Office would consider? When reading through the posts here, we found that there were very few newlyweds applying for FLR(M). We are worried that the fact that we've only just got married will affect the application. Many of the members apply successfully the day after the wedding...you must have missed their posts.
Question 2: We don't have any correspondences sent to us with the same address on because we are not living together. But I have order confirmation emails with my husband's address as the delivery address. Will these count as part of the proof that we sometimes live together? We also have a new tenancy agreement proving that we plan to live together from August. Will this be a good evidence? A slightly sticky one. You need to convince the Case Worker that your marriage is genuine and that you intend to live together. Emails are unlikely to prove anything. Submit the tenancy agreement and proof all contact between you. Also explain in 'additional information' why you haven't moved in together.
Question 3: If we send the application by post now, I doubt there will be a decision by the end of August which is when my employer will revoke my Tier 2 visa. Will the cancellation of my current visa have a negative effect on the application? No
Question 4: We intend to use both my husband's and my salary (£22,500 and £20,800 respectively) to meet the financial requirements. If my employment ends during the application, will my earnings still be counted into the adequate maintenance? If you have left before a decision has been made on the application, there may be an issue if the Case Worker calls your employer to confirm employment. If circumstances change during processing, you are required to notify the Case Worker. If your place of employment isn't within travelling distance of the address on the tenancy agreement, this may flag up the need to further verification. However, you could apply on the basis of your husband's salary alone if you choose to do so.
Question 5: If we use the premium service, will we still be asked to attend an interview or we will definitely get a decision on the day? There is no interview unless the validity of the application is questioned or the Case Worker suspects the relationship isn't genuine. Applications submitted at a PSC are generally decided on the same day.
