Complex ILR (10 year LR) Enquiry - Please Help

Post by ANjenga » Wed Jul 13, 2016 7:10 pm

Hi All,

I am approaching my qualification period for 10 years and am hoping to get some information before I go on to make an application. Any assistance I could get with this is greatly appreciated.

I came to the UK in September 2006 as an under 18 student(1 year), switched to Student Visa(2 years), extended student visa at the same institution (1 year), did a masters and got another student visa (1 year) applied for PSW in 2012 (2 years) and was lucky enough to get sponsored by my employers and was granted a tier-2 visa for 3 years valid until July 2017.

So here is where things get complicated. The company I was working for went into liquidation in January 2016 and I was made redundant in February 2016. The company has however still not been removed from the tier 2 register at the time of this posting and I have not received a letter from the home office curtailing my leave to 2 months. I have been able to maintain myself financially from my redundancy money (I have not been working) and have been waiting for mid August when my 10 year qualification period comes up. I have also been studying for the life in the UK test and hope to sit the exam in August. I will then apply for ILR through the premium service to get a quick decision. I have all of my passports covering travel in and out of the UK, have not travelled outside the UK for more than 3 months consecutively and have my University degrees as proof of english.

My questions are, considering the above points;

1. If I apply for ILR on the basis of long residence, will i need to provide details of employment such as bank statements, payslips, P60's etc? These would obviously not be available to provide after December 2015.

2. Is it possible for my ILR to be rejected based on the fact that the company I was working for ( through no fault of my own) went into liquidation and the home office was not notified by them?

3. Are there any specific questions the caseworker will ask for at the premium service center e.g. why are you applying for ILR, questions on employment, tax and etc?

4. how long would it take to get a decision and what is the likelihood of further checks being performed on myself etc such as looking into some of the things i have mentioned or trying to contact my employer etc?

Any further information or other options would be very helpful as to how I can successfully be granted ILR. I have been a lawful resident in the UK for this time and do hope I will not be discriminated against based on things outside of my control.

Thank you all for your time

You may be ok.

However you are required to inform the Home Office of any change of Circumstance.

Therefore you cannot say that everything is outside you control. You could inform them when the basis for which you were grant leave has ceased to apply.
