Egyptian boyfriend, plan to marry - 3 months pregnant

Post by Thequeen75 » Sun Jul 17, 2016 8:27 am

Apologies if I haven't posted in the right place or if there is something similar already ... I did spend a long time looking through but could not see anything
I met my boyfriend last October (2015) in Egypt , we speak most days and I've been back to see him twice ( in Jan and may this year ). We had been talking about our plans for future ( marriage and children) . When I came back from my last visit I found out I was pregnant ( totally unplanned and had bypassed my contraception but we are both very happy )
I have been looking at the visa application process and it all appears a bit complicated . If anyone could help me I would appreciate it . I earn £33000 a year so fit financial requirement I think
Do we
- Apply for fiancé visa? From what I understand we would then need to apply for marriage visa before he could work and I know that he would want to do so. Would it be better for me to travel to Egypt and marry before applying ? The length of time we have known each other obviously goes against us
- would there be any other options for visa? If he came on a visitors visa and then baby was registered by both of us could we then apply for him to stay in another way?

I appreciate that this may seem a bit fast to some but as I said it was unplanned although we had discussed for the future. We love each other very much and want to raise our baby together so any help you can offer will be gratefully received

Standard visitor visa is out of the question as you are not allowed to get married OR switch to another visa category while you are on one.

This is the visa he would need: https://www.gov.uk/join-family-in-uk/overview

The visa will initially be for 6 months during which time you should marry. He won't be able to work until you have married and he has switched to FLR(M): https://www.gov.uk/remain-in-uk-family/apply

If he intends to settle in the UK, he will need to renew the FLR(M) just before it expires as the visa is only valid for 2.5 years and he will require 5 years residence to qualify for ILR.

Options:
1. Marry in Egypt and your husband applies for a Spouse Settlement visa. £1195 + £600 NHS surcharge. This grants an initial 2.5 year visa to be renewed for a further 2.5 year period before qualifying for permanent residence (ILR). He can work freely on entry.

2. Apply for a fiance visa to marry in the UK within 6 months of arrival. £1195. (no NHS surcharge at this stage)
After the wedding he applies for a FLR(M) spouse visa from within the UK £811 postal + £500 NHS surcharge
A postal application can take 3 months to process, during which time he will be unable to work.
If you apply in person at a Premium Service Centre (PSC) for a higher visa fee of£1311 + £500 NHS surcharge, the application is generally
decided on the same day and he can work as straight away.

If you marry in Egypt there will be only one visa fee covering the first 2.5 year period.

They should grant a spouse visa for a period of thirty three months, allowing an extra three months for entry.

But the 30 days validity of the vignette, due to the new biometrics procedure, seems to undermine the extra three months.
