Advice

Post by bat » Sun Jul 17, 2016 10:54 pm

Hi All, can you please advise me or give me feedback ;

I have applied FLR visa ( July 2015) for private life settling nearly seven years . my son will completed 7 year in 04 Dec 2016 which is 5 months to go . they have refused my visa and did not give appeal right. so , my solicitor planning for Judicial review ; the pre-aciton protocol letter has been already sent to the Home office.

so, if home office do not withdraw our case; we will go for Judicial review may be in mid of September
( within three months of home office decision) ; can someone tell? by the time I will reach in final stage of Judicial review ; will it take another 2 and half months before reaching to final stage ; as if I applied in September mid ; I need another two and half months to reach 7 years complete)
if It will; what is the best step to go further ( do I need to wait for final stage of the process or as soon as i will cross 04.12.16 ; I can submit the new application to HO for completed 7 years ) .

thank you for your kind advice

Seven year concession isn't just racking up seven years, it's about compelling reasons why the child cannot reintegrate into the home state, seeing that kids are adaptable the UKVI want to know why this does not apply here.

Thank you Wanderer for your feedback . My son came to this country with me when he was 6 years old ; he had just completed year 1 in back home ; now is going to start year 9 in September ; he can not even write his name in our language; he is nearly 14 years now; he would not be able to adapt back home education system ; language barrier and social environment ; in fact he does not want to go back . So, really no idea what will be the outcome of Judicial review ; my solicitor has already send the pre action protocol to HO ; hopefully we will make necessary process for judicial review in mid of September but I am just wondering is it worthwhile to challenge and go for Judicial review or just to give up .

Do you have any idea if they will consider the best interest of child or not.
Anybody has experiences about this matter ;
