Evidence of Job Creation

Hi All,

I need some advice, I was last granted leave as Tier 1 Entrepreneur in September 2013.

See extract below from the Tier 1 Entrepreneur guidance -

Pre-6 April 2014 transitional arrangement
If a Tier 1 (Entrepreneur) migrant successfully applied to enter the route before 6 April 2014,
and they are making an extension application or a 5 year settlement application, they may
continue to employ:
• one worker for 24 months
• one worker for 6 months and one for 18 months
4 workers for 6 months each

I am looking to extend soon, but I think I may have mis-interpreted the information above.

I have employed 4 workers, see breakdown below
1) Currently worked 8 months full time and is still in employment
2) Currently worked 6 months full time and is still in employment
3) Worked 6 months full time
4) Worked 6 months full time

All these workers started at the same time.

Can I use this to claim job creation? Or do they all have to have worked at separate periods.

Your response will be much appreciated.

You should be fine as it appears that you have created at least 24 months of employment required

Separate work periods is not a requirement pre or post APR 6 2014

Thank you for your response.

I guess my concern was i saw it written a number of times that the worker must have worked for at least a period of 12 months.

The policy guidance is quite cntusing. 4 workers for 6 months sounds to me like i can employ four workers and stated in my previous post.

12 Months is for those entering after APR 6th 2014. You are fine on employment.
