I wanted to ask if anyone has expereinced what we are experiencing.

My husband is under the 10 year route as a parent.

On 16th june 2016 his stay expired, we applied on the 13th June 2016 as there was a delay in collecting my payslips from my manager but we have sent all the revelent documents.

On 23th June 2016 the HO has taken the fee out from my account.

On 03 July 2016 my husband had contact with the police and they could not find him on the HO database and had given him notice to report to a reporting centre. His first sign will be on 22th July 2016.

On 12th July 2016 a letter from HO has been recieved stating that there are issues that are raised relating to the European Convention on Human rights which are complex in nature and falls outside their normal service standards for deciding leave to remain application.

Now what the hell does that mean......

I thought he was under the 10 year route?????

Please let me know if anyone has experienced it. :|

What was your husbands status before the application was made? I ask because I don't believe there is any such thing as 10 year FLR(FP) 'route', unless the laws have changed dramatically recently and I managed to miss it.

we applied for flr m first on that basis the descion was made in 2013 that he is under the 10 year parent route.

now in 2016 he is due to extextend his stay we applied for flr fp as he is under the 10 year route.

If the application was made on the 13/06/2016 and his visa expired on the 16-06-2016, then Section 3C is engaged.

His leave is extended by virtue of the Statute and therefore the IS96 is ultra vires. It is not a lawful document. You must write to them to have it rescinded.

He is neither a person here unlawfully, neither is he a person who is liable to detention, neither is he a person without leave.

It follow that the Temporary admission granted is unlawful.
