Really difficult situation!!HELP

Post by Ecology75 » Fri Jul 22, 2016 12:02 am

Hi Guys.
Hope youre all well and in the best of health and mental being aa i think everyone who actively has made a profile and started talking on this group must have some difficult situation with regards to their family visa situation et al.

My situation is no different i feel but i have now realised that i had to make this account and ask rather than keep viewing other peoples issues as i did hoping that i would find my answers from the previous posts but so far i havent seen a situation as such hence any advice would be very very useful.

Ok so i am a self employed individual working for a limited company as a director and the company makes around£60,000 , however where i have gone wrong is by not drawing any money out of the company at all and living off a few savings in seperate bank accounts , however now with marriage and the requirements needed ive realised i need to be actively movingmoney to my personal account.
However this is where it gets tricky , i get 31k dividends a year i can move around 1.5k to my personal account no problem but i only make around 4k from wages the rest 6.5k personal allowance my father being from a Asian family who love doing everything at once put two rental propettys on my name he gets his tenants to pay him the money via cash in hand but the tenanats receieve DSS , i declare all the money and pay tax and have receipts if i have any losses that year as any normal person would.
My question is what do i do as my solicitor says they may ask to see the rental money moving into your account but i dont get nothing in my personal account im just about going to move 2k via wage and dividends to my personal account now lol never mind rental income.
Or my solicitor ( emigration advisor) told me not to declare the two propettys this year get your father to declare them as hr receieves the money not me and i can take 11.5k wages and rest dividends to make the 18.5k to call my spouse over.
If i get married in January , and move the money from August i should be able to call her from next August shouldnt i ?.

So can i get questioned on this rental income even though i declare it but it's not incoming into my personal bank account. H
Please help guys its really cofusing and my accountant tells me Jefferies and so does my v emmigration advisor and my family at the same time are doing by head in although I'm doing everything to help please them ie work doubt the wedding day in pakistan add opposed to england, but i dont know where to start
Thank you all

This question seems to be more about business planning, business organisation and tax (than immigration) - not really the remit of this forum.

Do you have a specific immigration-related question?

Director vs salaried employment

Post by Ecology75 » Fri Jul 29, 2016 10:01 pm

Hi guys , peace and blessings upon you i have just finally managed to get some information regarding how to get my wife over as my situation wasa little bit tricky as i had a lot going on with myself being self employe and not moving any money to mt bank account (personal) and getting money from rental propertys and both my accounting periods didnt match or show the movement of £18.5k to support a application.

My emigration advisor has now told me that i need to ask my accountant to avoid any more problems to join my company payroll and provide 6 month statements which will forecast a tearly wage of 30k.
However my question is that if i do this and show payslips will my ECO look at my case and realise that i am also a director by googling my name in the internet and then as a result. I have to wait a year and provide the self employes route which is 12 months worth of accounts , dividends etc or will my 6 month payslips as a employee of a limited company (my own) be sufficient ..this is what my emigration advisor has told me but i forgot to ask him this.

Any help will be appreciated guys.

Thank you

Well I'm fairly certain they will look at the background of the company you work for - once they see your name on top as the director they will obviously expect all the required paperwork for the limited company.

They will want to make sure the company and its accounts are all legit. The only way the method you explained would be potentially viable would have been if you were purely an employee of someone else's company.

Rental Income Bank Statement

Post by Ecology75 » Mon Aug 15, 2016 5:22 am

Hi would be rrally greatful if someone can comment because my solicitor and immigration advisor are giving me contrary reports its really upsetting im having to do this all on my own with lack of family help aswell.

I earn £40,000 self employed through dividends , what i wantes to ask though if part of my wage (£5000) comes through rental income however i do declare it but it doesnt come via bank account its cash in hand as its easier for tenants.
Will the ECO have a issue with this? Even though he sees £3000 xoming in every month from my business account.please help guys im due to get married in December everyone is happy with the celebration but dont realise the mountain ahead for me in terms of calling my spouse over.

Thank you

If you are earning 40k through dividends from your company why do you need to even use the rental income in your salary calculation?

By my understanding all you need to do is supply 12 months of both business and personal account statements - thus clearly showing the exact dividend/salary amounts going out and then coming into the personal account on the corresponding dates.

If this fulfills the financial requirements then that is sufficient. Any other income into your personal account is really none of their business as it is of no relevance to the application.
