Tier 2 Visa Extension Salary pro-rata as Experienced Worker

Post by max001 » Fri Jul 22, 2016 10:38 pm

Hi,

I am currently on Tier 2 General. My job Title is "Software tester" SOC Code 2139.
I have extension next year in October.

The salary rates for my code are as follows,
Salary rates: New entrant: £20,800* / Experienced: £29,900
[Source: Annual Survey of Hours and Earnings 2014]

Reference:
Codes of Practice for Skilled Workers
Standard Occupational Classification (SOC) Codes and
minimum appropriate salary rates
6 April 2015
Version 04/15
https://www.gov.uk/government/uploads/s ... _2015.pdfv

On the document it says that the rates are based on a 39-hour working week for all occupations where the salary source used is the
[Annual Survey of Hours and Earnings].

If this is correct then the £29,900 is based on the 39 hours per week.
I have 35 hours per week contract.

I have the following doubts,

- Is £29,900 based on 39 hours per week? (not sure)
- Can i pro-rata this salary based on 35 hours per week? Like for 39 hours it is £29,900 then for 35 hours it will be ~£26,800

Can someone please help me.

Many thanks in advance.

Kind Regards,
Max

The document says the following,

If the job has contracted weekly hours or is paid an hourly rate, the rates must be pro-rated accordingly
for the hours you are sponsoring the migrant to work, but otherwise they do not need to be pro-rated.

I don't know why the Home Office doesn't say things clearly and in simple words.
