Parent of Childeren 7 Years in UK

Post by javdak01 » Mon Jul 25, 2016 2:22 pm

Hi All,
I am in UK from 2008 on T4 visa, but my visa expired in 2013 and never renewed.
I have my daughter (born in Pakistan), she joined me later and going into school 6 and half year (she started school in UK)
My son born in UK and now he is 5 and half year.
My wife she also has no visa status, she was my dependent, but we seperated and now she living with children and I am living seperate, I have child contact / access order from court.
All of us have no visa status at this stage,
my question
a - Can we all apply on child 7 years rule
b - do we need to apply for child only first, when HO will give visa to child. then we can apply (parents)
Please advise
Thanks
Jawad Ahmed

In order for an application to succeed, you would have to show exceptional and compelling reasons why your children would be unable to
live in Pakistan. The UKVI are likely to take the view that your children are still very young and will easily adapt to life in another country. A child with 7 years in the UK doesn't guarantee you or your wife residence.

How are you and your estranged wife supporting yourselves if neither of you have legal residence?
