I seek for application advice in regards to permanent residence. The atmosphere around the Brexit business and some internal worries (I assume there would be a lot of people with this scenario around here) lead to mindless uncertainties and more sleepless nights! Naturally, it would be the best of interest for anyone to attempt an application for PR - or so I assume, being overly obvious here so forgive me! My situation is rather complex and I have some questions later after explaining my situation in best possible detail. I highly appreciate any advice, support or possible solutions that you may provide to me. Please ask any questions that you may have to help untangle this cluster of problems. Thank you.
Without further ado, I will briefly state the key points of my circumstances - at least in my belief. I have basic knowledge of the EU immigration laws which I gained outside these forums. (Which by the way, have provided an immense amount of help. Proud to have joined) Thereby, I will also try to brief you on my understanding.
Most primarily, I am a Polish National and I have lived in the UK for just over 9 years. I moved in July 2007 at the age of 10 with my family. I have educated here from Year 6 of primary school right until now. In other words, all of the time I spend in this country.
I am currently a returning, 2nd-year full-time student (At age 19). I have never participated in job employment. Additionally, I can now be understood as self-sufficient as I acquire funds from both Student Finance England and The University itself for me to basically survive. I may be wrong on the self-sufficient phrase here, correct me if I am please. I do possess substantial evidence for the above two paragraphs. So far so good.
The following is one of the major issues I could face: I currently have no CSI as it was a complete unknown to me before I embraced the power of the internet to realize this is a ‘thing’ for students. This is one of the major reasons that I may face difficulties, noticing how many people are in trouble because of this. I have no clear understanding of that unfortunately.
My key family member (also Polish) assumed to be the main 'sponsor' (I think this is the term used by the HO) and someone I was dependent on most of the time, was in constant employment for at least 7 years prior to today. If I am correct, this would mean that my family member is a qualified person and I am their direct family member onto which the laws could be passed on.
A further complexity comes here as well. Briefly speaking and as harsh as it sounds, at the age of 17 (September 2014), the circumstances put me into the last resort, henceforth leaving my 'sponsor' indefinitely. I finished my second/final year of A-Levels living independently with the support of the local authorities (child support) and the benefits system.
After finishing this period and simultaneously attaining my A-Levels, I managed to get on a university undergraduate course that I am attending today (Attending from September 2015), again with no CSI as for now.
I can provide a great amount of evidence for my so called 'independence' and my circumstances for the past two years that could be used to my advantage. However, any details (that I assume would be crucial in this scenario) on my family member and their economic activity in the UK (referring to their employment) are limited - acquiring direct evidence of their employment (P60, contracts, WRS etc.) is next to impossible.
This is where I am today with some questions I would like to ask. If you made it right until this point, thank you once again, it means a lot. I will give my current understanding of the situation along with those questions, for some foundation purposes. For all of these, I am not even close to certainty.
0) Is there any eligibility foundation for the PR and foremost, is it a realistic task given the above circumstances? This may be a blunt question but it is always better to ask.
1) Under what form, status (self-sufficient, family dependant etc.) and circumstances could I apply for PR certificate/card? For the best of my knowledge, I can take a guess that it would be something relevant to being a family dependent or a qualified person. I would most likely use an EEA(PR) form.
2) Will I need CSI at all, if I am eligible for PR? (From question 0))
3) Can HO consider the lack of evidence for a qualified person (referring to my family member) backed with evidence to support why is that the case? I understand that HO can take a pragmatic approach in some scenarios (like domestic abuse) but nothing else. If that's the case could HO trace out things like WRS or employment data from DWP, at their own accord to support my application?
4) If I do attempt an application, under the forms you suggest in answer 1), is there any risk of deportation if something goes simply wrong? I understand that an unlawful abuse of freedom of movement or becoming a 'burden to the society' can jeopardize a lot of things.
5) Do you have any more recommendations on what to do in regards to this situation?
Once again, I am in a fog with all of this. I do understand that no matter what answers or recommendations you make, this will be a challenging task if I choose to attempt at an application. Thank you so much for your time and effort.
