EEA4 to British Nationality...

Post by mehrazee » Tue Jul 26, 2016 12:16 am

Hi Friends,
Can you please advise me if this is the time to apply for my British Nationality. My Immigration history is as below;

Registration of marriage with an EEA National : 27th November 2009
Applied through EEA2 form for Resident permit : 20th January 2010
Got 5 Years Resident Permit on : 23rd July 2010
Divorced with My EEA National Partner on : 16th May 2013
Applied for EEA4 (Retained Rights of Residence) : 01st August 2013
Case Refused and 5 Years Resident permit Revoked : 12th February 2014
Appealed in Immigration Tribunal and got EEA4 (PR) on : 09th October 2015

As of Today I have completed six years from the date of first 5 Years permit issued and hold the EEA4 (PR) from last 10 months. I am in self employment from December 2012. I have Passed the Life in UK on 06th June 2013. Passed the Trinity College B1 English exam as well.

Question 1 : Keeping in Mind that I have lived Six years from the day I was issued the 5 Years residence permit being a family member of an EEA National & Hold the EEA4 (PR), Can I apply for the British Nationality?

Question 2 : I an in work from December 2012, before that time I was relying on My EEA national Partner financially and was not in any job or full time study apart from a short spell of job for 3-4 months in 2010. Is is necessary to practice my treaty rights (Either to be in Job or Full time study) throughout this 6 years to apply the British Nationality.

Please advise!

1) Apply via NCS who can check the date HO have recorded that you acquired PR status.
And/or request a SAR from UKVI which may also contain the date.

2) Employment is not a requirement for the privilege of citizenship. And as a family member of a Union citizen you were not in a position to exercise treaty rights; its irrelevant in terms of applying to naturalise.
In any case once someone has acquired the holy grail of PR there is no need to exercise treaty rights anymore.

Suggest crosscheck that your proof of English is a valid SELT.
All that is gold does not glitter; Not all those who wander are lost. E&OE.
