Need help in my final year of tier2

Hi everyone,

I applied for T2, for 2 years, on November 2011 with a Cos start date January 2012, it was a switch from T4. Got refusal on March 2012 as My employer made a mistake while filling the CoS. The job code was not according to the salary. We won the appeal afterwards and got passport in August 2012 and they issued the biometric card for the remaining period of that employment contract, expiry December 2013.

Applied for another 3 years extension on Nov 2013 and got visa up to Jan 2017.

My questions are:

1) Do I need another extension OR I am eligible for ILR and complete my 5 years on T2 general, with my current visa , expiring January 2017?.

2) If I need extension, how long should it be for?. either for the remaining 7 months to complete my 5 years or one whole year. Can I apply for 7 months extension?.

3) if I need extension, when should I apply?.


Your expertise will be very helpful and appreciated.

If applying for ILR as a Tier 2 G (not long residence), you will need to have held the T2G for 5 years - so you will need an extension. Up to you how long for and when you apply (as long as before expiry of your current visa. Bear in mind you cannot be a T2G for more than 6 continuous years.

I really appreciate your quick response on my query.

I do understand that what you mentioned. I have a confusion about my start date of t2 as you might have read my scenario where the first 2 years extension was not straight but we had to go through the appeal process and they issued biometric in the month of August 2012, when the employment contract was started on Jan 2012. I have spoken to many lawyers but some of them saying the start date is Jan 2012 and some said August 2012.

The five years starts from when you were issued the visa (CoS is not a visa). So if the biometric start date was August 2012, five years would be August 2017...
