Spouse Visa Rejection - Should we appeal?

Spouse Visa Rejection - Should we appeal?

Hi,

I am a UK Citizen, my wife is Russian. We comply with all the financial and language requirements but have been refused the application for 3 reasons:

1 - My wife had a Police Caution back in 2010 that she failed to disclose on the form since she was previously advised that it would be spent after 5 years. The application was rejected because of the caution and her 'desirability'. She has lived in UK for extended periods after this without any issues.

2 - We included a copy of my Decree Absolute but for some reason they did not accept it and were not satisfied our marriage was legal. It is clearly legal and I plan to obtain a certified copy of the decree absolute to be absolutely clear.

3 - We are currently living overseas but due to the Job market we will be relocating late in 2016 back to UK. They did not believe we had intention to move back. It might well be the case that I continue to work abroad but no doubt we will be back in UK for a period. What is the requirement for my wife to be in UK during the ILR process?

We have property in UK and consider it home. I do work abroad frequently through necessity but we plan to settle in UK.

My question is whether we should appeal the decision and provide more information to back up our case. At the very least it will give us a chance to clarify the situation before we reapply.

Any advice is appreciated
