ILR dependant visa; Newly started Ltd company

Post by sujayK » Tue Aug 02, 2016 4:21 pm

Hi,
I am an ILR holder and been with a permanent job for more than 5 years and switched to contracting on 25July2016 and as well started limited company. My wife and kid residing in India now and wish to join me at the earliest. I know it would have been easiest with the financial requirements met with permanent role but we were helpless then.
Since I (sponsor) am running my own ltd company that has just started, the accounts/tax returns are not available. I checked with a solicitor who asked me to wait a year before applying for my dependant visa! This would not be the case I believe and should have a work around. Can anyone please share their thoughts on how to deal with this case?

Regards,
Sujay.

Best case you'd still need to wait six months to show the six months payslips. The reality is the UKVI will want to see Ltd accounts, tax paid etc and that's but due until 9 months after the year end, because you are a one-man business and closely connected they consider it SE.

I had the same issue and had nothing to do except wait till I complete a company year to provide the documents.

However I invited my wife on a visitor visa meanwhile and that wasnt an issue. You could consider it.

Thanks wanderer & rshelar for your valuable inputs.

I have just started the new contract and ltd company. so no payments have been made. Is it a worth coming under an umbrella company for few months (to get the payslip and employer letter) and apply for visa and switch to ltd company. I am thinking that option will be much easier and neednt wait for too long. The documentation work is straight forward I suppose?

Probably best, still a six month wait though, and you can't claim expenses via an umbrella nowadays.

Agent might beef at re-assigning the contract best start there.
