If you are co-habiting you should not need to demonstrate proof of contact. Just proof of residence.

Hello there,
I'm married to EEA citizen and i want to apply for EEA RC. My tier4 case appeal refused by UT with no further appeal rights about 3 weeks ago. We are living in London since 1 year and we got married about 3 months ago.
My question is that my wife is working full time in subway since 4 months. She get the monthly payslips not weekly. She got only 3 payslips till now but the tax deduction which is mentioned on her monthly payslips is only £12.74 because of her tax code or maybe because she worked less hours? But she is working full time like 8 hours per day for 5 days in a week.
Will 3 payslips with less tax on her payslips cause refusal of work rights on COA or EEA RC?
Thank you

Specific tax deductions are not specified by the Directive or EU law.

Thank you for your response Sir.
So, it means i can submit fresh application of EEA RC with my wife 3 months 3 payslips with less tax? As you said less tax or deduction doesn't harm the EEA RC application?

It may be enough to show sponsor is a worker.
Suggest get letter ftom employer and/or contract too.

My wife got the initial work contract and also reference letter from her company which states she is working there since 3 months. Will that be enough to satisfy the caseworker?

If I was the caseworker I would accept that evidence along with the rest. (
Note I am definitely
not a caseworker).
Suggest keep scans/copies of everything you submit (plus form and payment details) - for future reference.

Hello guys,
I need your advise regarding my case please.
I'm non-EEA citizen. My wife is from Spain and she is working full time. We married about 4 months ago and we live together in London. She get the monthly payslips from her work company. I am sending EEA FM application this week. I just want your help and suggestion to complete the documents list.
My wife got the initial work contract where the company does not mentioned or show her hours. She also got the reference letter from her company. My first question is that should i send her work contract or not? (As i mentioned above there are no hours mentioned on her work contract)
Secondly, She got recent 3 months bank statements on post address while she also printed out the last 3 months bank statements but the bank just STAMPED on the front page (not on her each statement paper) (Feb 2016 to Apr 2016 printed out statements from local bank).
If i send her 3 post address statements and 3 months printed out statements (with one stamp on the front page) Will it cause any problem?
At last i am writing down the documents list which i will send with my application.
1: Marriage Certificate
2: My wife three months Payslips
3: Work Reference letter
4: Initial work contract paper
5: My wife (EEA) original Passport
6: My wife (EEA) driving licence
7: My passport copies (HO certified)
8: My DVLA colour photo copies (Just for residence proof)
9: My wife 6 months bank statements
10: My 1 month bank statement
11: Election Registeration letters (both)
12: NHS letters (both)
13: 12 marriage pictures
14: Six different pictures of us on different occusions
15: My wife HRMC letter
16: My wife mobile company letter
17: Joint Tenancy licence agreement paper
18: My 2x passport size pics and 1x same size pic of my wife.
Can you please simply advise or suggest me about the documents list which i am providing is right or something is missing which might cause my application?
Thank you very much guys!

Why not send your original passport?
Yes send job contract.
Do you have anything else for residency: voter registration, house and/or car insurance documents?

My passport is already in HO. I will send my passport certified copies which the HO sent me on my post address last year. We are living in sharing house so I'm sending tenancy licence agreement paper which shows that we are living in the current address since 1 year. I already added vote registeration letters. I also added my first and old tier4 visa photo copy which is expired. My wife got job contract letter but the company didn't show any hours that she work for that company. Will that be alright?
Do i need to add or change anything else?
Thank you

Hello guys,
I need your advise please?
I'm filling up EEA FM RC application form. There are some options which I don't understand?
Do i need to add or send my wife registration certificate with EEA FM RC application?
My wife is from Spain and she didn't register herself for registration certificate in the UK. She is working full time.
Secondly, There is a section asked about my sponsor work manager signature and stamp. She got job reference letter and also contract letter. Does she still need to sign or stamp that application section by her company manager?
Thank you for your advise and suggestion friends!

Sorry about that because I'm very stressed and confused as I'm filling the form for EEA RC by myself.
Can you please help me regarding the form as i don't have enough time left?
Do i need to fill up the complete form or if i leave empty some sections in EEA FM form, will it effect my application?
I.e Section 5 ask about when did we meet or start relationship? Should I leave empty this section as I'm sending all mine and my wife original documents?
Thank you very much!

Just fill in what applies. Section 5 would apply so fill it in. Support it with appropriate evidence.
Suggest keep scans and copies of all documents and the form and any cover letter you submit.
Also payment details.
- keep all for future reference and in case of any HO followups or dispute.

We are sending our marriage certificate and tenancy agreement. Basically we meet each other 2 years ago but we are living together since 1 year and we married 4 months ago. Its sounds complicated which scare of application rejection as well.
Do we must fill this section 5?

Hello there,
First of all, As I'm posting a lot of questions or similar posts about my case. It's 3:30 am in the UK and i could not sleep yet. I just completed eea fm application by myself. I'll be very thankful to any of you if someone just reply or advise me regarding my application post. I will send my application file today.
My last query or question is about EEA FM Form Section no 5.
Where it asks about SPONSOR (my wife) employer details i.e weekly hours, Weekly or monthly wages, Employer signature or stamp etc. The problem is that she work different hours per week, she get monthly wages and payslips. She get different wages/salary every months as her work hours up down difference.
My wife got her job contract letter (no hours shows on that) plus her job reference letter.
My question is that do i must fill the section 5 or i don't need to gill it as my wife got payslips, job reference and contract letter?
I'll be very thankful to you if anyone just reply me valuable advise or suggestion in the end before i submit my application file today!
Thank you

Can't see that section on section 5 on EEA FM form.
However if you want to explain something you can always include a cogent cover letter with the form (cross-reference relevant question)..
(You can simply turn what you have posted here into a short paragraph).
Good luck.

12 B is optional if you have an employer's letter.
For the hours and salary suggest put typical figures.
You can explain any variation in a brief note. For example "hours worked: 25 - 35 per week, usually 30 per week".
Ty and get some rest.

I been waiting for your reply as i just sent file today. I didn't write brief note about salary or hours in section 12 but i just wtite down average hours and wages as i compared my wife payslips and her bank statements. I hope HO won't mind it if they see i didn't write the exact or matching hours or wages.
Thanks again Noajthan. You always been very helpful and kind to me.
Kind regards
Mohd
