COS Rejected - Do i have access to the reasons of rejection?

COS Rejected - Do i have access to the reasons of rejection?

Hello Everyone;

My employer applied for a COS Tier 2 visa. They say the Immigration Office rejected the request. At the beginning they didnt want to give me the reasons behind the rejection saying that my HR is on holidays. Once she came back from her holidays, she gave me the reasons of the request on 3 times and everytime she adds a different reason reasona and she s a bit confused. As a result, I think she is hiding something and she might have made a mistake. I asked if she can send me a copy of the Rejection letter but she said no, it's private information to the company.

My question is: Do i have the right to have access to the Rejection COS letter? isn't it basic to access to this informtion? Did anyone ask for the rejection COS letter and had it?

Please i need your help cause i think this company has been non honest with me and made me lose 3 months of my life!

Maybe they have. Maybe incompetence rather than conspiracy, if that's any consolation.

But its doubtful you have any right of access to private correspondence between two legal entities.

The correspondence between your employer and UKVI is about an application for an allocation of CoS, not about a named migrant. Your employer may have done a good job justifying the need for migrant labour but UKVI didn't accept the need existed, or your employer did a bad job setting out their case and made UKVI's job easy. Either way no right of access from UKVI.

Named migrants only become relevant to UKVI when an employer wants to assign a CoS granted to them by UKVI. If there are no CoS to assign names are irrelevant. So a SAR to UKVI won't work because CoS correspondence will be on your employer's sponsor file not your migrant file and you cannot SAR someone else's file.

A SAR to your employer would work if you happen to be named in the correspondence, but I don't give much for your chances of later getting a job offer from them if you do that.
