Application to register child under 18 as British citizen

Post by varrush » Mon Aug 08, 2016 5:36 pm

Dear Moderators,
Mine seems to be a straightforward MN1 form case, but i have few queries if you can help clarify please,

My daughter born in India, arrived in the UK in Feb' 2010 (4yrs old than)
She and my wife received her ILR in May'2012 along with me as joint family application.
I received my naturalisation in 2014, but we deferred naturalisation of my daughter and wife until now.
I would like to register my daughter for British citizen (through form MN1) and defer my wife's naturalisation until later.

Can you clarify my queries while filling in MN1,
1) Please indicate the section of the British Nationality Act 1981 under which you would like the application considered. See Chapter 2 of the guide for details .. but the guidelines are bit confusing as i am already British citizen by naturalisation and my wife is not applying for naturalisation just yet... In this case what section apply and your rationale?

2) How do i fill in section 3 in my case, as I am not British by descent?

3) Do i need to fill in Section 4 - Good Character, as she is 9yrs old now and will be 10ys old in September.

4) How long the referees should be personally knowing my daughter, particularly her teacher or health visitor, as we have moved 4 residence in past 6 years (due to my changing work reasons).

5) Bio metric enrolment section, we have her ILR in BRP card, but can't recollect if her finger prints were taken at the time of ILR in 2012 she was 4yrs than. What option should i select 6.12 onwards.

6) Can i submit her application at Nationality Checking services, and what documents required?

1) Section 3(1) of BNA.
At Home Secretary's discretion.

2) Skip it - it doesn't apply to a 3(1) case. You are not BC by descent.

3) Complete if minor is age 10 years or more.

4) From memory, its not specified for minors. Can't check just now.

5) There is a cutoff age below which minors don't enrol fingerprints. My understanding is its 6 years old.

6) Yes.
See MN1 guidance, its quite comprehensive.

Thanks a lot for your inline response, much appreciated. Do you know what supporting documents i would need? Shall i include following or would you add more to the list?

- My British passport
- My wife ILR and her Indian passport
- My daughter Indian passport and ILR

Do i also carry my naturalisation certificate?

No need for naturalisation certificate.

Add:
Child's birth certificate to prove relationship to you;
Payment form;
Return envelope (if not using NCS);

For anything else I've overlooked, see MN1 guidance - its quite comprehensive.
