Lithuanian citizen working in uk With moldavian wife

Post by andrelis34 » Mon Aug 08, 2016 7:48 pm

Hello all. I have some questions regarding my legal right to bring my wife to uk.
I'm a lithuanian citizen who was working the last 5 years in Scotland.
I meet my girlfriend this summer in greece while on a working holiday.
She holds a Moldavian passport we are planing to get married in October in Denmark cause we can get a fast hassle free wedding there with appostile stamp for extra 750 euro in 1 day.
So I'm thinking when we get married just present the marrage certificate at the uk boarder and ask for a family visa. If anyone had a similar situation please advise.

You can do that.
Or apply for a FP.

Have a great wedding.

The thing is yes we can apply for Fp. But me and my fiancee don't like the idea of separating again and wait months for a Fp. We already are separated till October until we meet in Denmark it is very hard.
I'm worried incase at the boarder after our flight to uk they will refuse entry and try to separate us.

ate us.
Unlikely to work out by air.
You'd have to travel 'overland' (by sea).

You still need all the docs you would submit for a FP.

Be prepared for questions, stress and delays.
But people are stamped in in that way.

How are you, the OP, planning to get your wife to the British border? As far as I am aware, you wife would only be able to access it without a FP in France or Belgium. I don't believe ferries are allowed to carry visa national passengers to the UK unless thy have a visa or EEA documentation allowing entry. (Local journeys within the British Isles are the exception.) The bits of British border outside the UK are called 'juxtaposed controls'.

I'm planing go from denmark via plane with my wife on the same flight. And present at the desc our marrage certificate translated into English with appostile stamp. She has a moldovan biometric pasport which allows her to enter Shengenzone on arrival for 90 days. And I'm a working person in uk so I will present some payslips and bank statements with my adress on them.(if needed I can present them with payslips from the last 5 years of me being resident in scotland)

Note UK is not in the Schengen zone. So a Moldovan biometric passport permitting entry into Schengen area won't help get into UK.

You may have more success if you fly to France and then catch a ferry.

Agree that a flight back to the UK is a non starter. The airline will not even let your new wife onto a UK bound plane. She is a visa national and the airline will want to see a valid visa. Talk of EEA family member will cut no ice with them.

OK I thought someone might be interested in my story(succesfull) Me and my wife got married in Denmark got our appostile stamps on our marrage certificate.
I booked a flight for us from copenhagen to edinburgh.
And I didn't have any trouble getting to the UK.
In the copenhagen security check to board the flight I presented our passports and marrage certificate and we were allowed to fly to edinburgh.
In edinburgh border control I presented my payslips to prove that I work in uk.
A marrage certificate to show that she is my wife.
Our passports and a lease agreement from my housing agency.
The boarder guard was very nice and pleasant and gave us a small form to fill up which took about 15min.
After that my wife got a EEA family permit stamp on her passport for 6 months. Which he told we can extend before the 6 months are over.
Now we are happy and living in scotland!:) hope this helps to other people.
