Tier 2 - After maternity leave can I work part time?

Post by Padilla » Tue Aug 09, 2016 12:51 pm

Hello,

I am under Tier 2 and currently working for a company full time. I will be going on maternity leave for a year in about a month time (23rd Sept 2016).

The plan is to get back to work 3 days a week after my maternity leave ends (coming back 1st Oct 2017), I am a bit concern as I do not know if I can go back under my current visa (Tier 2 General)? Can I work part-time with it? I have got the feeling it might be a problem.

I am married to an English guy so worse comes to worse I guess I can apply for a marriage visa and work part time with it, I am trying to avoid this option as I just applied for the last extension of my Tier2 and would mean having to pay for another application.

Anyone knows about this topic? I would really appreciate any guidance..

Thanks a lot in advance
Gaby

I dont think u can go back on part time.. Maybe try negotiating for work from home?
Bear in mind that not only u will have to pay for another 2 x extensions, along with nhs fee, ur counter for ilr will also reset and u will have to spend 5 years before applying for ilr.
On brighter side, u will be free to work for anyone.

Hello,

Thanks for your answer. Is there anywhere this is stated? any UKBA policy?

This will not affect my ILR as I am applying through the 10 years route.

I don't think working from home will be an option for me but wanted to be 100% sure I cant go back part-time to think about what are my options then.

Thanks
Gaby

There is nothing in Tier 2 policy that prevents part time working with the exception of shortage occupation roles which have a minimum 30 hours rule.

I believe there is a minimum salary level for any tier 2 role outside of the new enterent / experienced requirements. So if your hourly rate times hours is above that level it will meet the need.

Thanks for your answer.

The salary is a good point I had not thought about, I think the new level is min £35k....

Thanks again,
Gaby
