Expert Advice Needed!!- EEA national 11 year and non EU 8 yr

Post by Robbie23 » Thu Aug 11, 2016 10:13 pm

Dear All,

Firstly thank you so much for creating immigration board and posting your advice.

Me and my partner got married recently. I'm a Non EU national on Tier 1 Visa, been living in the UK for 8 years legally. I have been on student visa, then PSW and then Tier 1.

My tier 1 application is due for extention in sep and I have prepared the paper work. I thought of going for the EEA (FM) route as it has less paperwork and cheaper.

At the same time my partner is applying for a PR, he has a EU passport. He has been excising his treating rights, i.e working as a full time professor for last 11 years. Now because of brexit he is thinking of applying for PR.

My question is

a) Can we both apply for PR at the same time ? - I have lived here for more than 5 years and married to EU citizen and he has lived in the UK for 11 years.

b) Can we both send our application EEA PR and Non EU EEA2 (FM) in one folder,as they strongly recommend that.

I have read about both the applications extensively and all the documents required.
I would highly appreciate any recommendations which could help me to speed up the process as it takes upto 6 months to receive the BRP. Any tips or suggestions which brightens up my caseworker's mood and process it fairly soon. Shall I write a covering letter etc. ?

Thank you xxx

a) No, not if you have been married to your sponsor and thus an EU family member for less than 5 years.

b) Yes

May I ask you to advise please?

Timeline to acquire PR?
For non EEA, 5 years as family member of Union citizen sponsor/qualified person.

For EEA, 5 years as qualified person.

I think the OP means how long does it take for an EEA Citizen to get a DCPR after applying.

Timeline here : Application for PR or PR card: form EEA (PR) - UpToDate.

What is the nationality of the EEA citizen?
