UK Spousal Visa from Tier 4 Student Visa

Hi, this is my first post so any help would be greatly appreciated

My wife is a student under the Tier 4 Visa in Northern Ireland and has been for over a year. My question is can she switch from her Tier 4 visa to a Spousal Visa without having to leave the country? Also is it possible to use the same day service for this?

I am working full time In Northern Ireland and have a UK and Irish Passport.

Welcome to the forum.

Yes your wife can switch to a spouse visa from within the UK by submitting a FLR(M) application assuming you are able to meet all the conditions, including minimum annual income of £18,600 (earnings can be joint) This will set her on a new 5 year route to settlement (2.5 + 2.5 years).

An application submitted in person at a PSC will be £1311 + the NHS surcharge of £500. If she doesn't have a degree taught in English she will need A1 level English from an approved test provider.

Thanks for the quick reply.

In another query we were also considering moving to the Republic of Ireland (ROI). I have been trying to obtain information regarding the process and financial requirements for this and have been unsuccessful.

Are there complications as I am living in Northern Ireland and have a British and Irish Passport?

Just a clarification on this point, whilst making the initial application; if my salary is 15,000 and my wife's income is 4,500 (total 19,500). My wife can only work 20 hours per week under the working requirements of a Tier 4 Student Visa. Would that be acceptable?
