T2 visa questions, RMLT, and advertising on Jobcentre Plus

Hi,

I am in the UK on a T5 youth visa that expires May 2017. The company I am working for may be interested in sponsoring me. However, they would have to conduct an RLMT.

While reading the guidance doc around T2 visa's . There were a few things I noted around the process.

The whole advertising for 28 days, in two places one of which is Jobcentre Plus all seemed pretty clear. The hold up for me is this part:

“Jobcentre Plus, and Jobs & Benefits Offices and JobCentres in Northern Ireland will only accept online vacancy advertisements when there is a current vacancy at the time the advertisement is placed”

I already know I need to go back to Canada to apply for a T5, but do I need to quit my job before they can conduct an RLMT even?

Ie can they advertise my role while I am still working there? Or can I still be working there but have to officially filling another role? Or can they start advertising the Job 28 days before I would be to leave with the start date sometime before I leave (to account for time it would take to actually find someone before I leave and hiring someone for a transition period, would that qualify as an open vacancy?)

Honestly for me I would ideally like my company to conduct an RLMT in January so they could get the CoS say March(I believe I read somewhere they have to apply for the CoS within 3 months of when they first advertised the role) Ie it would be nice to know ahead of time if I am moving back to Canada in May or going back to apply for a T2 visa to come back. Or will I just be living with a ton of uncertainty in April.

I know I will be incurring tons of fees for this process (costs to apply for the visa, potentially last minute flights ) But does anyone know what this will cost the company to sponsor me?

What about the fact you would be pre-selected thus making the RMLT a sham?

I am fully aware the point of the RLMT is to ensure UK citizens have the right to apply for the Job. Right now I am in the UK on a valid visa and I have every right to my current job. I am just trying to do research and ask questions so I have all the correct information and can plan as much as possible for whatever the outcome is.

Either way before I leave they will have to look for someone to replace me. I am asking so I can provide my manager with all the correct information and they can decide if the way they look for my replacement fits into the proper RLMT procedures. (Generally they actually go through a recruiter which would not fit into the RLMT process) That way if there is no one they can apply for a CoS, and if they find someone then they have found my replacement.

Realistically they need to advertise the role with enough time to find potential candidates, then more time is needed to interview said candidates, and find someone who can start before my leaving date. The last person they hired the interview process took about a month since the applicants had to be interviewed by multiple people (which is pretty common at this company) and that person is starting before the other person leaves.

Hopefully this makes more sense:

Can they start advertising the role while I am still working there in that specific job role? and it still fit into the RLMT process? Is that not still a valid current vacancy? Because they do in fact need to advertise for the role while I am still there
