Switching from Derivative residence card

Hello everyone again,

I will be grateful for some insightful knowledge on this subject. I have a derivative right residence card based on my two daughters being British. They became British as a result of having been born here and residing here for the first ten years of their lives. i live with my spouse and it was due to financial reasons that made us applied for derivative card.We are in a good place financially now and would want to switch to parent of a British child route(five years). My questions are our DRC have not run out yet but we would like to switch to another route, will the home office cancel the remaining years on the DRC if we apply to switch to leave to remain as a parent of a British child when we become successful with that application. My spouse has a MSc degree from a university in UK and i have a first degree as well. My second question i understand the law regarding parent of a British child route does not favor couples is that right.

Unfortunately you will not qualify under the 5 years route as neither of you can qualify as partier as neither are settled, not can you qualify as parent, as both of you are in a relationship.

The only thing you can get is leave outside the rules, which provides a 10 years path to ILR.

Thanks Obie for the feed back. it is a shame neither of us can use the five year route really. i suppose the rules are intended just to benefit single parent
