Hi
I was hoping someone can help me on here. We applied for a spouse visa and were refused.Even the solicitor is baffled as to why. Basically we went the self-employed route and after three minths received notice of the refusal. Reasons for refusal are as follows:- From the finacial requirements (they copied them) and then said you have not provided (I). Therefore refuse your application under paragraph ecp1.1 (d) appendix fm of the immigration rules.
First of all what is (I) is it (i) annual self assessment tax return sent to hmrc..... We sent this
Or could it be (I)audited accounts (not needed) unaudited accounts were sent.
Or is it (i) a franchise aggreement signed by both parties... Not needed I am not a franchise.
They then go on to say there are no exceptional circumstances and why cant I just visit my husband in Morocco???
I showed this to my solicitor who had checked my documents were all included before sending, and she said that its ambigious statement and not clear which (I) in the finamcial.requirments they are referring to. She suggested I send a PAP. We sent this to the home office and they wrote back saying they stand by their decision and cannot accept documents that should have been included first time...which they had been.its so frustrating and I am so lost. What do I do? Go to tribunal or reapply? But if I reapply how do I know there not going to pull something out of my file that is completely bonkers like this one! And if I wait for tribunal maybe i will be waiting up to a year....
