Tier 2 ICT expiring - do employment laws, protections apply?

Post by mdk316 » Fri Aug 19, 2016 5:02 pm

I am a US citizen and currently hold a UK Tier 2 ICT visa, which will expire in Feb 2017 (I have already extended and this is the end of 5 years in the UK). My UK employment contract is based on me being legally eligible to live and work in the UK. I would like to remain in the UK, but I know there are no options to switch to Tier 2 General. Therefore, my employer will lose its ability to sponsor me after Feb 2017. T If my employment contract is subject to me being eligible to work in the UK and my company can't sponsor me in the UK, am I entitled to redundancy payments by UK law?

No, because it's not redundancy, role will still exist.

I should rephrase the question. Would I be entitled to any compensation by law? Or would it be an ad-hoc arrangement that I would have to negotiate with my employer?

Not by law.

And surely you knew the deal when you started out.
After all, what employer would take someone on if they found out they had to pay a surprise golden handshake at the end of it?!
