Is there any formal way to complaint about service standard of UKBA? Any way to take them to court in case of which they have failed to comply with their service standards?
I want to make a formal complaint in relation to the promised service standard by the BRP Return Unit. On the 1st of August 2016, I posted with special delivery my incorrect BRP which contained a wrong ‘valid until’ date to the BRP Error team. Even after 13 working days have passed, I am yet to receive the amended BRP although I was promised by the BRP team in their only email communication that I will receive it within 10 working days since the day they will receive my BRP, and the day it was received by them was 2nd August. If they had not mentioned about the 10 working days limit, it would have been a different case. They also did not say 'minimum 10 working days', they said 'within 10 working days' and I have evidence of the email from BRPError email.
This is a breach of the promised service standards mentioned in the official communications by the UKBA causing my work related travel to be disrupted, cancelled and uncertain, family related visits outside the UK uncertain, thus adding to the overall stress around day to day normal life. Having a clear and transparent service standard from UKBA would have helped to manage expectations and work/life schedules which are seriously impacted by absence of a valid BRP.
Chain of events in relation to the wrong dates printed on my BRP and my efforts to resolve the problem.
2nd August: Incorrect BRP received by BRP Returns Office
1st August: Incorrect BRP sent by me via Royal Mail Special Delivery
24 May: Response received from BRP Error Team acknowledging the printing error and requesting return of BRP.
10 May: Response received from Admin Review team that the application for Admin Review had been rejected because it was invalid and it will not be considered since it was not about an ‘eligible decision’. They mentioned that “As there is a possible error with the expiry date on your BRP, we have contacted the original caseworker in order for them to look into this for you. The original caseworker will be in touch with you in due course”.
12 April: As per instruction on the BRP letter, I applied online for Admin Review by selecting the option “(that UKBA) made an error in calculating the correct period of immigration leave either held or to be granted”.
11 April: I received my BRP which printed incorrectly the ‘Valid Until’ date, instead of 30 months of visa, I was granted visa for 6 months
5 April: I applied using the form FLR(M) for extension of Leave to Remain following the Five Year Partner route at PSC Croydon Same Day Appointment. Decision received of being granted limited leave to remain for a period of 30 months under paragraph D-LTRP1.1 of Appendix FM.
If anyone can direct me to right direction, I am keen to explore any legal ways to bring to account UKBA. As long as I am playing by the rules, I see no reason why they should not be held accountable.
