Currently I am on my 4th year of Entrepreneur visa and thinking to apply for ILR on basis that my business now has already turned over £5 millions during past 3 years.
So here is a brief history of my situation:
September 2012 applied for Entrepreneur visa
September 2015 Applied for Entrepreneur visa extension and it was granted and my current visa expires on September 2017.
When I have applied on September 2015 for extension, since I already created 2 full time jobs, and met all requirements, I was granted the extension.
However since now my business has already turned over £5m, I think I should be able to apply now on accelerated route so I don't have to wait another year.
Now here is the question, from my understanding in the form, I cannot use the jobs I have created previously and I must demonstrate creation of 2 new jobs. Because the employees I had left on April 2015. However now I have 2 new employees working for me since January so duration of the new jobs are not yet 1 year each.
Here is the details:
Please advice.During your period of leave as an Tier 1 (Entrepreneur), you must have created 2 full time jobs
for 12 months each across your business(es). If you created 2 jobs in your initial application, you
may use these jobs to claim points for settlement, if they were maintained for at least 12 months
during your extension period of leave. Alternatively, if the jobs you created during your initial
period of leave no longer exist, you can create 2 more in your extension period of leave, and
claim points for them - if they exist for at least 12 months.
