URGENT- Settlement visa to join as partner in UK- REFUSED

Hi Guys,

Many thanks for your time looking into my request.

I am SELF EMPLOYED and having settled status(ILR) in UK. My wife had applied for my SETTLEMENT visa from INDIA but visa got refused yesterday based on tax/CT 600 for current financial year. I had given tax/CT600 for 2013 till 2015.

They have written I can APPEAL. I am planning to go for appeal with current financial year tax/CT600. They have asked for salary slip/bank statements matching period for current CT600.

My QUESTION is:
1. For Appeal, do I just have to send the new documents for TAX or do I have to send the whole set which I applied first time along with passport.(as whole documents are returned after refusal)
2. Do my wife/daughter have appear for appeal or can I just send the documents?
3. Appeal will be in UK or India -> where I have to send the documents?
4. Processing time please?

Thanks guys, I have found answers to all the question on the forum except 1.

Could you please let me know this please

Settlement VISA refused due to improper financial documents of sponsor so when I appeal then just submitting the form IAFT6 (along with payment receipt )with only financial documents is needed right?

I don't need to submit again all the other documents like accommodation proof, marriage certificate, whats app chat, emails, phone logs, TB, English test etc.

Sorry which form for appeal for Settlement Visa form India which is refused on financial documents missing.

IAFT-2 or IAFT-6

I compared both forms both look exactly same except the below difference

IAFT-2 --> talk about Type of Decision: Settlement, Non Settlement, Family Visit [TICK ONE]
IAFT-6--> Talks about Type of Decision: Human Rights (HU), EEA (EA) [TICK ONE]

So I believe my case is Settlment refusal appeal so I should go for IAFT-2.

If any one can confirm this I will be grateful.

The issue was I had given CT600 for 2013-2014 & 2014-2015. I had not got CT 600 for 2015-2016 which I am getting now as I am filing Tax now for August 2015 till July 2016.

so they refused saying the Salary slips/dividend is given for June 2015 till May 2016 but CT 600 is not given for matching period.

Now I am appealing with this year CT600 supplied and salary slip, dividend, bank statements for matching period same as CT 600.

Only struggling which form is right one? Any idea?

CT600 is not due until 9 months after accounting period end or am I missing something here (likely).

You can apply under category F or G - i.e. last one year or last 2 years.

Basically as a rule the salary slips and dividend voucher you submit must match the period for which you have provided CT600. You dont have to provide one for 2016 if you have old payslip and dividend voucher.

They were correct to refuse as you should have provided payslips for 2013-2014 & 2014-2015

If the accounting period is complete, the CT600 can be done the day after if really required - it's just up to the accountant to get a move on. The 9 month date is the limit after which there may be charges/fines etc.

With regards this case I agree with Rshelar - if wage slips were provided for the period of the CT600 which had been provided, then they would have probably been accepted as the guidance asks for your last completed tax year information.
In any case a fresh CT600 with recent statements and slips should make everything a lot more straightforward.

Will they accept my appeal if I provide latest CT 600 for August 2015 - July 2016 and matching salary slips, bank statements, and dividend vouchers. Please confirm? Appeal will make any sense or not?

My understanding from reading people's experiences on the forum is that appeals can take a long time - although if you have been given the right to appeal and provide what they have asked for, then there is a good chance your appeal will be successful.

However if I was in the same position - and I had the funds to make a new application- then I would take that route as a decision is usually made within 3 months or so as opposed to potentially more than double that time on appeal.

This is my personal opinion so see what others have to say as well.

Documents which weren't made available to the Case Worker in the decision making process, won't be taken into consideration during an appeal. With this in mind it may well be preferable to re-apply, even more so as an appeal can take 12 months or more to be heard.
