FLR(O) invalid as fee waiver refused - what next? Worried

Post by Kimly » Sun Aug 21, 2016 11:56 am

 Hi guys. I'm new on here and looking for advice. Would anyone be able to advise what happens in such a case where a fee waiver is refused and application is returned as invalid? The letter states that we can make a fresh application which will be dated when they receive it. However, that will mean that it has been logged out of date as original application was made within leave time. As discretionary leave, do we still have right to appeal if they reject the application? Virtually got no money to seek legal advice as going to get a bank overdraft to afford the application fee. Any advice is highly appreciated. Thank you.

FLR(O) isn't for discretionary leave and therefore has no fee waiver. Is this the application you submitted?
(Casa, not CR001)
Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.

Thank you for your response Casa. Yes, this is the form I used as I had a look on gov.uk and this was the appropriate form to apply for extension of stay outside the rules. It said somewhere to fill the waiver form if I wanted to apply for a waiver. Should I have used a different form? Would you know which one?

I believe FLR (o) and FLR (FP) are covered by Free remission.

FLR (M) is not .

Thank you for this link, Obie. So I'm going to resubmit the application and pay using the overdraft. I just hope nothing goes wrong there. Just worried that the application will be rejected sighting lateness. I know that HO will use anything to reject applications so just trying to get my tracks covered.

Wonder if anyone has experienced this before?

Hi Kimly:

Have you sorted out the problem?
how about the period between expiring date of last LR to the date you submit a fresh application?

thanks

Jack
