EU1 Parents Refusal by INIS

Post by FP007 » Tue Aug 23, 2016 9:03 am

Hi,

We recieved letter of rejection from INIS for EU1 parents application rejections stating that i have not proved that i am exercising treaty rights in State. We have given right of appeal within 15 days, i think the rejection is unjustifiable, however we submitted following documents:
1. Work Contract (UK company stating work base in Ireland permanently)
2.Tax Credit Certificate from Ireland authorities
3.Pay Slips in sterling but addressed to Ireland address
4. P60 UK uptil April
5. UK P85 showing leaving UK
6. UK HMRC letter showing left UK and working in Ireland
7.Bank Statements showing transactions
8. Spouse work Contract in Ireland (Spouse is EU national too)
9. Spouse Pay slip in Ireland (Spouse is EU national too)

Please help what to do in this situation, appeal on EU4!!!!

Where have we gone wrong we dont understand
I dont know where the mistake has happened in

Appeal is probably appropriate .

Seems unjustified.

FP007,

Is there any update on your appeal?

Did you not submit any documents related to the dependency?

You have not made any mistakes but the "UK employer in Ireland situation" is a grey area that INIS seems to use as an excuse to refuse applications because "technically" you are still employed by the UK and not Ireland although you are physically living and working here

You would have not had this problem had your wife applied for your parents instead of you (and there is no law to say otherwise) as her status would have been considered. I know this for a fact because a friend of mine did the same back in the UK, his wife applied for his parents and they were granted the visa

Just a thought here but,

Can't you get yourself a part-time job in Ireland too so you satisfy INIS that you are exercising treaty rights in the state?
I know is a short period before appealing but it may be worth a shot, desperate times may require desperate measures

Good luck
