Airport queue and passport stamping FP/RC

Post by gmgmgm » Wed Aug 24, 2016 9:18 pm

Hi there,

I am an EEA citizen married to a non-EEA national. We currently have an application pending with the HO for her RC. While we are waiting for the HO to process our application, she went to her home country and applied for a FP. The application was successful and she received it today :D . My questions are the following:

1. If she enters to the UK by herself, can she use the line for EEA citizens when crossing the border at the airport?

2. From now on she will be traveling abroad quite a lot for her job. Are they going to stamp her passport every time she enters/exits the UK? I know this may sound like a fussy question but having to do a new passport every few years because of the continuous stamping would be very annoying.

3. Is the answer to the previous questions the same once she will receive the RC?

Cheers
Gabriel

1) Think so, yes.

2) 1st world problem.

Apply for extended page passport.
Persuade employer ro refund expense.
Not sure FP holder passports are stamped anyway.
And isn't employment in Western world, and travelling for business, better than the alternative?!

From BF Ops manual:
Border Force officers should continue to date stamp a passport containing an EEA Family Permit on the holder's first arrival in the UK and may also
use their discretion to date stamp such documents on each subsequent arrival unless the passenger holds a residence card.

Date stamping a non EEA Family Member's passport endorsed with a Family Permit does not breach free movement rights under the Immigration (European Economic Area) Regulations 2006
3) No. See #2
A Border Force officer may not place a stamp in the passport of a person who holds a residence card when he is admitted to the UK, even if they do not hold an EEA family permit

Regulation 11(3) expressly prohibits an officer from endorsing the passport of a person who holds a valid residence card or permanent residence card.

Advice on this thread confirms that your spouse can use the EEA queue at the airports.
