Status of Baby Born in UK with UK Citizen Father + FLR Mothe

Hello Experts,

I have a query regarding my situation. My Wife is a FLR status dependent and is currently pregnant. November will be the delivery date of the new born.

I received my citizenship on April 16. My Wife received her FLR when I was in ILR on Jan 2015. The reason we both did not get the Citizen on the same time is because I was newly married and my wife entered the UK on Jan 2014. UK dependent visa rules were changed on 2012 where spouse need to go through the 5yr route to get her ILR then Citizenship.

I would like to know what status will the new born have when we both are in the UK during the delivery.

I am getting mixed messages, so I wanted to ask your help to guide me on this topic.

If born in the UK, the child will be British along with whatever nationality the mother holds. However, should the mother be a national of a country that does not allow dual citizenship, you have a choice to make, British OR other citizenship with RoR.

The child will be British wherever it is born.

As to acquiring the nationality of the mother, that depends on the laws of the countries of her nationality. For example, if she were Australian only or Iranian only and the child is born in the UK, the child would only be British at birth.

As other interlocutors have advised, your child will be born a British citizen wherever in the world it is born as you will be a British citizen at the date of birth.

Is your wife Indian as well?

If so, you child can also get Indian citizenship if the child's birth is registered at the Indian High Commission within one year of birth AND provided that you have not applied for a British passport for the child. The child's Indian citizenship will lapse either at the age of 18 years or on application of first British passport, whichever is first.

Sorry sorry!! Had missed the fact that the OP had acquired British citizenship. I had (stupidly) thought he was on ILR!!!!

Arg. Yes the child will be British (other than by decent if born in the UK).

Newborn - Citizen and Passport Procedures

Hi Experts,

My baby is due next month and I would like to get all documentation and applications ready to apply for a British Passport.

I recently acquired British Citizen early this year. My Wife is on ILR dependant until mid 2017. I raised a question earlier in the form to know what status will the baby be given once born in the UK. Experts replied saying the baby will be granted British Citizenship.

In order for me to apply for the British Passport, What are the initial steps ? Do I need to get a naturalisation certificate and then apply for the passport or since I am a citizen and baby is born in the UK can few steps be skipped?

Documents Required:
Birth certificate
Father Mother Passports

Please list other documents and application forms / procedures

Child is born a British citizen. Apply for a passport using the form available at the Post Office.

You will need to supply:

1) Your naturalisation certificate or British passport
2) Your marriage certificate (possibly)
3) Your child's long form birth certificate.

If your marriage certificate is not in English, there may be issues as to what form of validation is required for the translation. It might be possible to not supply the marriage certificate, but the birth certificate struck me as poor evidence for the recorded parents' being married.
