Withdrawal of FLR FP

Post by JessOrchid » Sat Aug 27, 2016 10:44 pm

Hi All, I'm a widow and Mother to a British child aged 4 and currently in Scotland as a visitor. I submitted my FLR FP application on 28 June 2016 and received a letter from Home Office on 15 July about European Convention Rights and nothing since then. Not even biometrics letter. I phoned up the UK visa hotline and was asked to send an email to Appointment Exceptions. However, Appointment Exceptions replied that they have nothing to do with my case because their job is to handle biometrics enrolment. 9 weeks have passed and wonder how Long more I have to wait for a decision as I have to be return to my home country in Oct to settle some family matters and would need my passport n other docs. Should I withdraw my application now to get my documents back or should I keep on waiting for a decision to be reached? What are my chances of getting the parent visa? Appreciate some advice. Thank you.

No one can tell you your chances, especially with the limited background you've given to your application. However, FLR(FP) applications generally take a considerable time to process and for a decision to be given.
Who is currently caring for your child?

IMHO, you should have applied for an entry visa under Family life as a parent of a child in the UK, not FLR(FP) as a visitor.

Thanks Casa!

I am the only one caring for my child. Maybe I should withdraw my application and re apply for family visa instead of FLR FP? But shouldn't the HO send me a letter to inform me that I have used the wrong application form?

No, the HO aren't under any obligation to inform you of the correct application and are unlikely to do so.

From what you've now said, it appears that Zambrano may be more appropriate. Where is the child's father?

You'll need to explain the situation with you and your child to avoid to-ing and fro-ing in order to give the correct advice.
