Switch to Tier 2 from FLR (FP)

Hi,
I'm the dependent of my wife. My wife was in tier 4 student visa of west London college & the cass was issued by Herriot Watt university as a governing body. We came together in 2014. In the last semester of the degree my wife failed in 2 subjects but they were unable to issue new cass due to the contract issues between west London college & Herriot Watt university. In that situation we applied for FLR (O) requesting time to attend the next exam since university allowed us for registration. So, my wife attended the exams and she was at the last stage of her pregnancy as well but unfortunately this time she failed 1 subject. Still we didn't get any result from home office.

Then we again applied for FLR (FP) as a variation according to the suggestion of my lawyer. This time again we requested for time to attend the exam in December 2016. We also mentioned that my baby has born in the meantime. We just applied 2 weeks ago & didn't receive any update from home office till now.

Now the issue is that, my company where I work agreed to give me work permit. I already gave my English exam ISE I & I passed as well.

My questions:
1) As a dependent can I apply for tier 2?
2) ISE I is it appropriate exam as an English test?
3) What's the possibility to get tier 2 visa from FLR (FP) application considering my situation?
