Naturalisation (EEA Route) - help please

Post by mfreeman » Mon Aug 29, 2016 12:44 pm

Afternoon,

Apologies in advance if our questions has been answered previously, we are very confused so any bit of help would be much appreciated. :D

I'm a family member of EEA national (My wife). I have a UK issued residence permit, my wife is a permanent resident since June 2015. We are both thinking about applying for naturalisation however this is proving to be very confusing indeed. The questions are:

Can we apply together (I have not obtained my PR status yet) but once she's naturalised I'm assuming the rules applying to me will be those of spouse of British national not EEA?

If the answer is no and she applies now, will this change my status as I will be spouse of British citizen?

Following the recent change in November, will I have to wait till I obtain PR (next year) then wait a further 12 months before applying for naturalization?

Hope someone would be able to help, thanks in advance!

Be careful and don't assume anything :!:
You only get one shot so take your time and do it right.

You need to acquire PR and confirmation of same (PRC) first of all.
:!: As soon as wife is BC she cannot sponsor you.

 So get your PR and PRC in the bag first.

After that wife can naturalise.
 When she is BC you do not need to wait 12 months before applying for privilege of citizenship.

Thank you very much for the info - much appreciated.

So once I obtain PRC which should be next year, can we both apply at the same time without having to wait a further 12 months? Sorry to be a pain but I just want to make sure I got the facts right :)

No, not together.

But once one party is a BC the other can apply under 6(2) of BNA (as spouse) instead of under section 6(1) as a standalone applicant.
