Question 1.3

Hello,

I'm an Italian citizen and I have been living in the uk since June 2005. I have always worked, with only few days betwwen jobs, mainly during my first year in the UK.
I have been given Permanent residence in May 2016. My question is about the answer I should give to question 1.3 of the AN application.

Should it be June 2010, which when I completed my 5 year of exercising treaty right, or June 2011 (5+1)? I want to get it right so to avoid any delay with my AN application.

You don't have ILR.

There are relavant questions about PR status at 2.4

On which base do you say that I don't have IRL? For how many years do I need to Hold the status?
I have been living in the UK for 11 years now!

11 years doesn't come into it.

But relax.
You don't have ILR because that is for persons on UK migration route.

if you are on EU migration route you have (or need) PR.

I have PR and the card was issued in May 2016. So now I can apply for the British citizenship only after May 2017?
I thought I had reached my ILR after my 6th year in the UK, same as the example in here: https://www.freemovement.org.uk/eu-nati ... lications/

Forget about ILR. For you its all about PR.

When did you start exercising treaty rights? And by extension, when did you acquire PR?
Its not necessarily the last 5 years (or 6 years).

Its nothing to do with when the PR card was issued which, in some cases, could be years after someone acquired PR.

If you've been in UK 11 years then yes, you may have acquired PR 6 years ago.

The freedom from immigration time restriction is 12 months after acquiring PR not 12 months after getting the confirmatory DCPR.
And if you are fortunate enough to be married to a British spouse there is no delay imposed at all.

Hello, as I said above I came in the UK in June 2005! Which I believe it is when I started exercising the treaty, so what should I put in the question 1.3?

This is like groundhog day.

You don't have ILR. Leave the question about ILR blank.

Answer 2.4. because you do have PR status.
Anything else can go in 'additional info' section of the form.

You may have to get a SAR from UKVI to see what date HO have recorded for you as to your acquisition of PR.
And NCS have a hotline to HO by which they (not you) can check the date HO thinks your PR was acquired.
