If currently living abroad, the UKC would have to prove they have earned above £18600 (more if you have non-UK citizen children moving with you) in the previous 12 months AND have a guaranteed job offer in the UK to start within 3 months of arrival. If your spouse does not earn the requirement, they would have to earn £18600 pa in the UK for six months before you would meet the financial requirement.
If you came to the UK on a visitor visa, you would have to leave to a country where you legally have residence in order to apply for a family settlement visa.
