Tier 2 General to ILR / New born Indian passport

Hi all,

I am Indian citizen entered UK in Sep 2009 on student Visa and started working in the UK from 2012 on Tier 2 General. I have my tier 2 visa till 2018 and my wife came as a dependent in 2013 ,I have few questions I need some advise on.

1) When will I be eligible for ILR and what are the document required?

2) When can my wife apply for ILR ?
Is she eligible to apply with me or will she have to apply for some other visa i.e extension? Any other requirements for my wife?

3) We are expecting our baby this month and need to understand what will be the process of getting Indian passport from UK.
What type of UK visa is needed as we are planning to visit India after birth and fees ?.
Is there any requirement for Birth registration and if so what is needed in order to do so ?

4) Will our baby be eligible for citizenship or ILR once I get my ILR ?

I would really appreciate some advise on the above points.

10th anniversary of entering the UK, if you are applying on the basis of Long Residence.
5th anniversary of starting work as Tier 2 G, provided you are still on that visa and meet the salary and other requirements.
I believe the latter will be earlier for you.

It depends on which of the two options above you go in for.

If you get your ILR based on Long Residence, your wife will have to switch to FLR(M) and the clock will be reset to zero and she must spend five years from the initial grant of FLR(M) before she gets ILR.

If you get your ILR based on your T2G visa, your wife continues on her PBS dependent visa and should be eligible for ILR when she completes five years as a PBS dependent, so in 2018. She will have needed an extension in between.

So, make sure that you meet the requirements of T2G -> ILR. That would make it easier and faster for your wife and you.

Congratulations.

If child is born in the UK, s/he can be registered as a British citizen when any one parent gets ILR.

If child is born outside the UK, s/he can be registered as a British citizens when both parents have ILR and one parent has become a British citizen.

If child has an Indian passport, his/her status will be in line with that of the less-privileged parent. So, the same visa as the mother, in this case.

I will be applying next year on basis of 5 years on Tier 2 G. Can you please help me with some of my queries?

1) I got the Tier 2 G on 17-Jul-2012 , can I apply for ILR after 17-Jul-2017 or can I start before that ?

2) What are the document requirement for ILR ?

3) I have decided not to apply for Indian passport for my baby and wait till my ILR to naturalize her as British citizen. What will be the process to apply for baby's naturalization and when will i have start this process?

If parent choose to have child in the UK. Child will have stats of the most privileged parent. ILR if the most previlegede parent has ILR .

Child wI'll not have status of less privileged parent.
