There is NO SUCH thing as 28 days grace period. HO simply allows up to 28 days of overstaying before the date of your visa application.
If you make an out of time application, you remain an over stayer without any rights to work until your visa application is processed.

If your visa is rejected, you will have no other chance to apply again in the UK and you could be removed from the UK.
If your visa is approved, you will end up with a gap in your continuous period of stay in the UK.

Dear Zimba,
What happen if the applicant applies after completion of 3 years, there is 4 months stay in the visa, that means applying 4 months before the visa expiry, 3 years(initial)+ 2 years(extension)= 5 years.
Kind regards
Jafer

Dear Zimba,
Let's say that initial visa on 11/03/2014
Expiry date on 11/07/2017
Can I apply on 12/3/2017 , I mean after completing 3 years. The extension will be 2 years, total is 5 years, after that I can apply for ILR.
Please advise
Thanks

You can apply as far as you fulfil all requirement but it good to apply one month before the initial visa expiry,
Strong commitment, extreme faith and honesty will recognize your existence.

Yea..I think since you got 4 months extra on your visa, as your initial applicatio valid for 3 yrs + 4months, which is for applicants outside the UK. But, it all depends on when you start trading in the UK to know if you really have the extra 4 months

Yes, that is correct. As long as you arrived in the UK early on

Dear Zimba,

Many thanks for your answer,
I will apply on 12/03/2017 because I complete 3 years on 11/3/2017. But my dependents will complete 3 years on 27/5/2017, about 76 days after my visa. Can I apply alone first and I apply for them on 28/5/2017.
Please advise
kind regards
Jafer

You or your dependants do not need to complete 3 years to apply for extension. You can apply for extension anytime you want. I suggest you apply as soon as you can because the process takes at least several weeks (it might even take months!). This will enable you to apply earlier for ILR when eligible
