well here is my case:
I am a Pakistani national came to UK in Oct 2010 on student visa, changed it into EEA2 after getting married with a EU national. Marriage in Jan 2013, visa issued in June 2014. Since end of last year having serious issues (she was cheating on me) in April 2016 I started divorce on unreasonable behaviour and Decree Absolute will be issued in 2 weeks. So far its simple. Well in meantime I found out she got pregnant( in January) and because of complications in pregnancy she went to her country in July and gave birth premature
I will apply for Ror as soon as divorce is issued, but have few questions and would be grateful if anyone could help me with this messed up situation.
Until she was in uk she was quite helpful so i have her payslips until June, since then she is on maternity pay i guess, and she is not answering my calls anymore.
So does maternity leave considered as exercising treaty rights?
Will they check if she is in the country? (i think she is coming back in a few month)
If i apply end of September and show them payslips until June is it fine?
I have supporting documents for living together for 3 years and she was working almost all along( 3-4 months she stayed at home), so what you think what else I need? also should I go for legal advice or this documents will be enough for ROR?
