Done Civil marriage.. suggestions for next step

Post by Rafi89des » Sun Sep 04, 2016 5:09 pm

Hello everyone

Well here is my immigration history..

22/10/2015-- Home office curtailed my visa because my college lost their licence.
16/12/2015-- I did a tier 4 application to home office. didn't take the biometric test for this application as i lost first copy and my solicitor advised me to get another biometric paper from HO.
19/12/2015-- Curtailment date ends
28/02/2016-- Married my partner (religious ceremony)
06/03/2016-- I did (vary) FLR fp application with all evidence needed. partner's pp/Bank statement and everything from my end
06/05/2016-- given biometric test
10/06/2016-- given marriage notice together
17/06/2016-- received a letter from home office mentioning 'i need to go HO to get my application decision' @5th July 2016. My solicitor send email to home office explaining that i cant go to HO that day because of religious festival. And he also asked HO to give a new date to visit. HO mentioned on the letter i can email them if there is any issue.
26/07/2016-- Received a letter from HO. IS96 liable to detain and monthly reporting schedule.
02/08/2016-- I went to HO reporting and it went smoothly.
05/08/2016-- Immigration enforcement stormed my in laws home. i was living with them since February. I was in gym with my partner when they entered at 5.50 am. on the search warrant they mentioned me as an immigration offender.
11/08/2016-- received letter from home office mentioning that we complied with the HO marriage investigation so we contacted register office and booked ceremony day.
02/09/2016-- Completed civil registration successfully

So My question is

1) I am going to HO reporting on Tuesday. will they arrest/detain me??
2) My solicitor applied to HO to get my Data from home office to know my immigration status 1 month ago. when we will receive this data?
3) I did't receive any refusal letter from home office for any application, am i an overstayer? if i am how can i remain in UK?
4) My partner earns £20044 and doing this job from 2013. If i go back, can she apply for me straightaway? is there any legal obstacles?

I would be grateful if you can help me here. Sorry for the long post. Thank you

Rafi.

1. Highly likely
2. If your solicitor doesn't know, how would we know? We don't have inside information.
3. You may not have received a letter but you were asked to attend an appointment to be given the decision, which you chose not to attend.
But you do have this: "26/07/2016-- Received a letter from HO. IS96 liable to detain and monthly reporting schedule."
4. Much depends on how you have supported yourself while you have been without valid leave and whether you have 'frustrated the Immigration Rules by working with false documents, unpaid NHS bills etc. Otherwise you shouldn't face a ban for entering on a Spouse visa.

Hi Casa

Thanks a lot for replying accordingly. Have following questions for you ! Please...

1)I always worked 18 hours from 2014 and never had any cash in hand job. After getting my curtailment letter I instantly gave notice to my workplace and (because they schedule one month advance)last I worked on November 2015 (curtailed date \dec 19 2015) and received last payslip on December 4. Since then I didn't work anywhere. I have my Uncle in UK and He was supporting me since then. And sometime my partner helped me as well.

2)I never wanted to 'frustrated the Immigration Rules' in any possible way. If they listed me as an Overstayer or Immigration offender, how can I clean this record from my Immigration history?

3)They issued the warrant on 01/08/2016. I went to the HO reporting the next day. They could've detain me on that day, but why they came home 4 days later??

4)My partner went to my country once 13 year ago. She doesn't have any relatives in my country. She doesn't know our language. Moreover She has two younger twin Deaf brother, who needs her to communicate via Sign language. She is the only family member who knows proper and supportive Sign language. Is there any chance she can use this things on the application?

5)The last thing: :( :(
If they detain me :( , how can i convince them that i am ready to leave voluntarily. I can pay my ticket fare and everything but my only ques here is, Will they ban me from entering UK??

Hi Casa

Thanks for your reply. It cleared some things..

I always worked 18 hours since 2014. Never had any cash in hand job. I lived with my uncle so didn't pay any rents. After i received the curtailment email, I instantly gave notice to my work and (because they do one month advance schedule) last worked on November 2015 (curtailed date dec 19, 2015). Since then my uncle helped me by giving some (irregular) weekly basis pocket money.

I never wanted to 'frustrated the Immigration Rules' in any possible way. I can leave voluntarily but me and my partner's only concern is, will they ban me from entering if I go back??

I dont know but im just asking about the civil marriage certificate. Can I show this to HO persons if they wanna detain me and will it make any differences???

Thanks a lot for your previous reply..
