Discretionary Leave to remain

Dear All

I am quite new to the forum/boards, so please bear with me if someone has already asked a similar question. A little background … My wife (Chinese National) applied for HSMP in 2011 and I (an Indian national) applied for depend (switching from students’). It was refused but through a lawyer it was settled outside the court and my wife was granted the visa in march 2012 to 2014 and strangely i got the right for private life in UK but same dates as my wife.

In 2014 feb we had a baby and my wife did not work for more than 6 months before extension was due .. so we applied for my extension on right for private life and my wife as exceptionally circumstances (human rights). I received my visa for 3 years in July 2014 (to July 2017) but my wife got the refusal. We appealed and lost. And then we made a fresh application in feb 2015 which got refused as well but strangely my baby got the discretionary leave (like me) till July 2017 (without passport)… We again appealed my wife’s refusal and won the case in January 2016 … Home Office appealed the decision straight away and now the court is sitting on the appeal for past 8+ months.

In the meantime, in Nov 2015 we’ve had another baby. So presently my wife’s appeal is still with the court and for my second baby we haven’t applied anything yet (as in no passport or visa)

- In these circumstances will I be able to get an extension,
- should i apply for extension for my baby as well
- should i apply for the babies’ passports
- What’s, if any, remedy for court taking so long for the decision

Any advise for the queries or suggestion to remedy the problems are most welcome.

Hi, when did you get discretionary leave? What's the reason you got it?

Thank you JC .. I completed 10 years in 2012 sept so I applied for 10 yrs route and they extended my discretionary leave for 3 years instead ... So I really want to know if my extension in July 2017 will be effected with my wife s pending appeal ..
