Child in USA adopted by previously British parent

Post by andrewbee » Wed Sep 14, 2016 7:29 pm

Hi,

I adopted a baby in the USA when she was a newborn. I was still a UK citizen on a green card at the time. In 2007, when she was 6, I became a US citizen. My adopted daughter is now 15. Will she have the right to reside in the UK, or some kind of dual citizenship?

Thanks

Are you still British?
Did you adopt under US or UK law?
What do adoption papers say?
Does child have any passport?

Thanks for the reply. I am not still British, I am a US citizen. She was adopted under USA law. She has a US passport. Not sure what you mean about the adoption papers... she was an American, adopted in America, but I was still British at that point.

Thanks

As per my understanding, an adopted child takes on the nationality of the adopting parent.
So if you were British that would make the child British.
Unless its somehow done differently in USA.
Hence the suggestion that the adoption paperwork issued at the time may give a clue.

If child was British then surely she should still be British (as she won't have 'inherited' your new nationality later on).
Did you actually renounce British citizenship? if not you are surely a dual citizen, still British too.
