me and directive 2004/38/ec

me and directive 2004/38/ec

Hello everyone,

Me a national from the netherlands who lives and works in the netherlands and never worked or lived in any other eu country, going to the philippines on november and meet my wife there (we are married).Now after 3 monthes i want to book a vacation to belgium together with my wife.Do i fall under this directive 2004/38/eg Yes or No?

*never worked or live in other eu member state
*traveling to other country then my own

Yes. You do fall under eu directive. Don't have to live or work in other eu country to fall under with free movement directive.

I'm British I got schengen visa for my wife under eu directive. We never been to that eu country before we got the visa.

Now i have a question related the shengen application form.Under question (21) main purpose of the journey.What do i check there? is it others? and then specify (I will accompany my husband who is a citizen of The Netherlands on our joint holiday in belgium)

Select tourism. Don't fill in the sections marked with little star. From 31 to 33 I think. Write a joint statement and explain you both are married and explain with purpose of ur travel and say you want the visa should be issued under eu directive.

Find some documents regarding eu free movement directive incase you have to explain to the embassy. Some times the embassy staff pretend they never heard about the law.

Mark others and write family member EU.
Don't give them a excuse to deny the visa.

have 1 more question, when we arive in belgium with my wife, is it then possible to bring her to my own country the netherlands, by train? or is this against the directive2004/38/eg

A visa for a family member EU is issued as a schengen visa and a schengen visa is valid in the whole schengen area. Therefore also in your home country.
Apply for 90 days.
You should enter the schengen area via the country who issued the visa.

Sorry to jump into the thread-
My understanding of schengen short term visa is=
Its valid for the countries (member state) which we included in our application.
Is it not the case?
