"Switching to new Sponsor as previous sponsor was suspended"

Post by Deco111 » Tue Sep 20, 2016 2:00 pm

Dear immigration experts,

Your advice on my below query would highly appreciated.
I am currently on Tier 2(General) visa issued on Oct 2013 which get expire on Oct 28, 2016.

Now, couple of days ago we came to know my present sponsor’s Licence was suspended and my sponsor advised us to find new sponsor for my renewal. however luckily I get through an interview and a new sponsor came forward to provide me the new CoS.

But before I proceed further with my application with new sponsor, I had below list of questions in mind. So please someone of you experts kindly advise
1. I am planning to go for one day premium service during next month so what could be my application success rate as my current sponsor was suspended. Will it going to affect my new application as my sponsor currently suspended. Do they ask any questions like why you are changing the sponsor, Why it was suspended or how you got this new sponsor …and so..!!
2. My previous CoS given by suspended sponsor had mentioned the work dates starts from
21 Oct 2013 till 20 Oct 2016 in the old Cos. So just in case If I got premium one day service appointment only after 20 Oct 2016, will they raise any questions like to whom you are still working as your work date with old employer was already end by 20th Oct …so on.
3. I am currently on Job Type 2139- Information technology and telecommunications professionals
So now with my new application through new sponsor and with new Cos I would like to change job type with an annual package of gross £40,000 as I negotiated.
But my previous Cos provided for only £ 28,400. Will it be any issue if I change gross salary to £40,000 along with my new sponsor Cos.

I would be so greetful if any expert kindly advise in clear.

Thanks in advance.

1 no
2 no
3 no
you need to stop worrying and apply for new visa.
these are point based visas, which means if everything they need is there, they cant refuse and if anything is not there, they cant give u a visa
read tier 2 guidance, to make sure everything is properly done.
you need cos, rlmt done by new employer

Thanks a lot you both for your immediate response.

Regarding RLMT,

Even though I get through interview bit early with my new employer, he had not yet finished 28 days of RLMT. And which could probably finish 28 days by 17th Oct 2016. So they are planning to issue the Cos immediately after that date.
So, hope it could work fine as they are issuing after 28 days, Correct..!!
Please advice if there any other constraints involved and that I need to check in sure before apply for renewal.

Thanks again for your time and kindly response.

:!: Incorrect.

RLMT is not a tickbox exercise designed to shoehorn you into a lovely new dreamjob.

RLMT is to determine that there is noone else in UK or Europe who can fulfill that role.
Sounds like you've been pre-selected if you've already been appointed before the 28 days is up.
The adverts make sure that there are no suitable workers already living permanently in the UK. It must be a genuine vacancy.

How long to advertise the job for
Each advert must run in the UK for 28 days in most cases, either continuously or in 2 stages.
If you advertise in 2 stages, each advert still needs to run for a total of 28 days and neither stage can be less than 7 days.

You must be able to show that you didn’t find a suitable worker.
Sounds dodgy
- how can this employer show that if 28 days hasn't completed yet :?: :!:
(that's the way licenses are revoked)

Omg, I might get wasted my precious time through listening to their unreal stories.

Thank you so much dear experts, your information was really worth full. I will immediately get into market and look for a genuine sponsor who really interested in my profile.

Thank you.
