'Deport first, appeal later' - Spouse Visa?

I read an article on BBC which stated that the 'deport first, appeal later' rule which was previously introduced to deport criminals or unsavoury characters has been extended to all appellants.

My question is would this affect anyone on a spouse visa who couldn't for example meet the criteria at FLR or missed documents and wanted to appeal. Or does it just apply to people who are in the U.K. Illegally to begin with?

The information in the link you have posted is likely to be as much as anyone on the forum can confirm at the present time.

That seems to be an old link as the "Immigration Bill" they talked about seems to be the Immigration Bill 2015? That became law in May this year and became the Immigration Act 2016.

If you look around on here, you will see why they had to bring this in. People putting in for something they know they can't get and then when refused, they appeal, trying anything to stay in UK. These people always ruin it for the genuine.

It does seem very harsh, that you could be deported for i.e. a missing payslip when applying for FLR and then have to appeal from your home country. What happens to British children involved are they expected to leave with the parent too. Seems to draconian.

The cost of appeal is going up to over £800 (500% increase) as of Oct 11th I think.
